Terms of service
What you get, what it costs, what we each promise, and how either of us ends it.
Version 0.8, effective 2026-09-21. Samuel Davis trading as Crads AI.
Plain terms. Between you and Samuel Davis, trading as Crads AI, ABN 26 929 349 775, Coogee NSW, Australia ("we", "us"). By running a mineral you agree to these. By booking a paid session you agree to them too, including section 10 on cancellations and refunds.
(Changed in 0.8: section 10, cancellations and refunds for paid sessions, agreed with a tick box at booking.)
Version 0.5, effective 1 September 2026. (Changed in 0.5: the self-host redesign. Crads AI no longer provisions, hosts, bills for, or holds any account over minerals: you create your mineral on your own hosting account with the setup wizard, and the software is free. Everything in versions 0.1 to 0.4 about beta pricing, the 26 September pricing decision, invitations, suspension of hosted machines, and our provisioning obligations is gone because the machinery it described is gone. Prior versions stay on the record.) A lawyer reviews these before any paid service programme grows; the version and date change whenever the text does.
1. What you are getting#
Software, free of charge: the mineral image, the engine, the desktop app and the documentation. You run it on a mineral: a server you create in your own hosting account, holding an assistant and a brain that belong to you. One person's private workspace; we also call it a pebble.
We maintain and publish the machinery: the container image, the engine, the app, the scheduler and the system pages. You own the machine and the content: your server, your brain, your pages, your skills, your cadence, your connected services.
2. What it costs#
The software costs nothing, and that is not an introductory state. There is no plan to charge for it, no payment method collected, and no mechanism in the software that could bill you.
What you do pay, to other people, on your own accounts: your hosting provider for the server (Hetzner or DigitalOcean, whichever you picked, billed by them to you), and Anthropic for your Claude subscription. The setup wizard states both before anything is created.
Paid services exist separately: guided setup, working sessions and hourly support. Each is agreed with you at a stated price before any work happens. Buying none of them takes nothing away from the software.
We are not registered for GST, so no GST is charged.
3. Your accounts and your responsibility#
- The hosting account, the server and every credential on it are yours. We hold no key to your mineral and cannot access, suspend or delete it.
- Your assistant runs on your Claude account under your agreement with Anthropic, and your usage is subject to it.
- Scheduled skills spend your own Claude plan's usage. Every scheduled run and every Telegram exchange is your assistant working on your account, and it draws on your plan's limits like any other use. The software floors repeating schedules at thirty-minute intervals for exactly this reason. If your plan runs dry, scheduled runs fail until it recovers; that is your plan doing what plans do, not a fault.
- You are responsible for what you ask your assistant to do and for what you connect it to. Automating a decision is still your decision, as the acceptable use policy puts it.
- Anything you put on your mineral must be lawful and yours to put there.
4. What we promise#
- We do not read your notes, and we could not. Nothing of yours routes through us: no account, no directory, no telemetry. The privacy policy sets out the one exception honestly: a support session you deliberately grant.
- We tell you when something is broken, including when we caused it.
- Every fix ships with the test that pins it. That is how this is built and it is the reason to trust a fix rather than a reassurance.
- You can leave with everything, trivially, because everything is already yours: your brain is a git repository you hold, on machines you hold.
- We give notice. If we stop publishing the software or wind the project down, you hear it with a date attached. What a wind-down means is set out in the continuity page and those commitments are part of these terms.
5. What we do not promise#
Being specific is more use to you than a disclaimer.
- No uptime guarantee, because uptime is not ours to guarantee. Your mineral runs on your server at your hosting provider. What we promise is visibility: the app shows each skill's last run and its outcome, so a missed run shows up as a missed run rather than as silence.
- No guarantee your assistant is right. It is a language model working from your notes. It will sometimes be confidently wrong. Check anything that matters before you act on it, and never treat its output as legal, financial, medical or tax advice.
- No guarantee a connected service keeps working. Google, Microsoft and the rest change their APIs and their rules whenever they like. When one breaks we fix it if we can and tell you if we cannot.
- No guarantee of data recovery beyond your own backup. Your mineral takes a nightly encrypted backup to a repository you own. If no repository is connected and the machine dies, the content that only existed there is gone. Connect the repository.
- We are one person. Not a company with a support rota. Response times depend on one human being awake and not on a mountain.
6. What the software may do to your mineral#
- Update it. Your mineral restarts nightly onto the latest published software. The change is machinery, not your files, and you can switch the nightly update off. Old software keeps old bugs.
- Let a helper in, only when you grant it. Support access needs a grant from you, expires on a clock the mineral's own door enforces, and the grant is recorded on your own mineral (what is and is not logged is set out in the privacy policy). There is no standing key.
There is no suspension power and no kill switch. We could not act against your mineral if we wanted to, which is the design.
7. Ending it#
You, at any time. Delete the server in your own hosting console and the arrangement is over. Nothing needs our involvement, no reason is required, and nothing is clawed back: your repository, your backups and your files stay yours.
Us, with notice. If we stop publishing software or providing services, we say so with a date, per the continuity page. Your mineral keeps running regardless.
8. Your content, and ours#
Your brain, your pages and your data are yours. They never reach us, we claim no licence over them, and we will not train anything on them or use them to build anything.
The engine, the app, the images and the documentation are ours, and are provided free for running minerals. The project is being prepared for an open-source release; until a licence file says otherwise, do not resell the software as your own product.
9. Liability, stated honestly#
This is free software from a sole trader. Our liability to you is limited to what you have paid us for the software, which is nothing, and for any paid service, to the price of that service. We are not liable for lost profit, lost opportunity, your hosting bills, or anything your assistant got wrong that you acted on without checking.
Nothing here excludes rights you have under the Australian Consumer Law that cannot be excluded. If a term of these terms is unenforceable, the rest still stands.
10. Paid sessions: cancelling and refunds#
This covers the paid services: the walkthrough, guided setup and any extra hours. You agree to it when you tick the box at booking. Both packages are two sessions paid for up front.
- Cancelling with at least 24 hours' notice. Full refund, or a free reschedule if you prefer. Email cradsdavis@gmail.com.
- Cancelling with less than 24 hours' notice, or not turning up. No refund. We offer one reschedule instead.
- After the first session has happened. No refund for a change of mind. The second session stays yours to book whenever suits you.
- Slack support. The 30 days of support come with the package and are not refunded separately if you do not use them. Extra hours after that are A$233 an hour, agreed before any work starts.
- If we cancel. You choose a full refund or a new time.
- If something goes wrong on our side. If a session was not delivered with due care and skill, or did not do what we said it would, tell us. Your rights under the Australian Consumer Law apply, including a refund where the problem is a major one, and nothing in this section limits them.
11. Changes#
Material changes get told to you with a date, not slipped into a page. The version and effective date at the top of this document change whenever the text does, and the previous versions stay on the record.
12. Law, and complaints#
New South Wales, Australia. Talk to us first: cradsdavis@gmail.com. Most of what goes wrong is fixable by telling the person who built it.
